General provisions



The Chinese trade union is a mass organization of the working class under the leadership of the Communist Party of China under the leadership of the Communist Party of China. It is a bridge and link between the party and the masses of workers and staff, an important social pillar of the state power, and a representative of the interests of members and workers.



The Chinese trade unions, guided by the constitution as the fundamental activity criterion, carry out their work independently and independently according to the trade union law of the People's Republic of China and the constitution of the Chinese trade unions, and exercise their rights and fulfill their obligations according to law.



The working class is the leading class of our country, the representative of advanced productive forces and productive relations, the main force of reform and opening up and socialist modernization, and a powerful and concentrated social force to maintain social stability.

Guided by Marx Lenin doctrine, Mao Zedong thought, Deng Xiaoping theory and the important thought of "Three Represents", the Chinese trade unions carried out the implementation of the party's economic construction as the center, adhering to the four cardinal principles, adhering to the basic line of reform and opening up, promoting the implementation of the Party's fundamental guiding principle of relying on the working class wholeheartedly, fulfilling the social functions of the trade union, safeguarding the overall interests of the whole nation, and better expressing and safeguarding the specific interests of the staff, United and mobilizing the whole nation to work hard and make pioneering efforts for the purpose of building our country into a prosperous, strong, democratic and civilized socialist modern country.



The basic duty of Chinese trade unions is to safeguard the legitimate rights and interests of workers.



China's trade unions mobilize and organize workers to actively participate in construction and reform, strive to accomplish the tasks of economic and social development; represent and organize workers to participate in the management of state and social affairs, participate in democratic management of enterprises, institutions and institutions; educate workers and staff members to continuously improve their ideological and moral quality and scientific and cultural quality, and build an ideal, moral, cultural and disciplined workforce.



In the process of developing the socialist market economy, Chinese trade unions, while safeguarding the political rights of workers, maintain the workers' labor rights and material and cultural interests, and take the participation in coordinating labor relations and regulating social contradictions as an important task, and strive to promote economic development and long-term social stability.



The Chinese trade unions maintain the socialist state power led by the working class and the people's democratic dictatorship based on the alliance of workers and peasants, assist the people's Government in carrying out their work and play the role of democratic participation and social supervision in accordance with the law.



Chinese trade unions, in enterprises and institutions, support the administration in exercising their management power according to law, organize workers to participate in democratic management and democratic supervision, establish consultative systems with the administration, protect the legitimate rights and interests of workers, mobilize the enthusiasm of workers, and promote the development of enterprises and undertakings.



Chinese trade unions carry out the principle of organization and leadership combined with industry and locality, and adhere to democratic centralism.



Chinese trade unions insist on mass and democratization, maintain close ties with members and rely on members to carry out trade union work.

The leading bodies of trade unions at all levels insist on focusing their work on the grass-roots level, serving the grassroots and serving the staff wholeheartedly, strengthening the vitality of grass-roots trade unions, and building trade unions into "workers' homes".



The enterprises and undertakings set up by the trade unions are committed to serving the reform and opening up and developing the social productive forces, serving the masses of the workers and serving the cause of the cause of labour and pportation.



The Chinese trade unions work hard to consolidate and develop the alliance of workers and peasants, uphold the patriotic united front, and strengthen the great unity of the people of all ethnic groups, including the compatriots of the Hongkong Special Administrative Region, Macao compatriots, Taiwan compatriots and overseas Chinese, to promote the reunification, prosperity and prosperity of the motherland.



China's trade unions adhere to the principle of independence and extensive ties in international affairs. Chapter I members



Article 1. All manual workers and mental workers who take wage income as the main source of living in enterprises, institutions and organs within the territory of China can join trade unions as members without regard to nationality, race, sex, occupation, religious belief and educational level.



The second staff members who join the trade union shall be voluntarily applied by themselves, through the discussion of the trade union group, and approved by the trade union's grass-roots Committee and issued a membership card.



The third member has the following rights:



(1) the right to vote, the right to be elected and the right to vote.


(two) any organization or any staff member who criticize the trade union shall ask for the replacement or removal of the trade union staff and supervise the work of the trade union.


(three) put forward criticisms and suggestions on the state and social life problems, and request the trade union organizations to truthfully reflect them to the relevant parties.


(four) when the legitimate rights and interests are violated, the trade union is required to give protection.


(five) enjoy preferential treatment such as culture, education, sports, tourism, medical treatment and recuperation sponsored by the trade unions, and enjoy various awards from the trade unions.


(six) take part in discussions on trade union work and workers' concerns in trade union meetings and trade union newspapers and periodicals.



The fourth member fulfills the following obligations:



(1) learn politics, economics, culture, science and technology, and learn basic knowledge of trade unions.


(two) actively participate in democratic management and strive to accomplish the tasks of production and work.


(three) abide by the Constitution and the law and discipline, uphold social ethics and professional ethics, and observe labour discipline.


(four) correctly handle the interests of the three parties of the state, collectives and individuals, and fight against acts that jeopardize the interests of the state and society.


(five) safeguard the unity and unity within the working class, carry forward class friendliness, and do well mutual aid and mutual aid.


(six) abide by trade union regulations, implement trade union resolutions, participate in trade union activities, and pay monthly membership fees.



The relationship between the fifth member organizations varies with labor (work) and is pferred by membership card.



The sixth members have freedom of retreat.

The withdrawal of membership will be made by myself to the trade union group. The trade union grassroots committee announces that it will withdraw and withdraw its membership card.



Members who do not pay the membership fee or do not participate in the life of the union organizations for six consecutive months without proper reasons and refuse to correct after education, shall be regarded as an automatic withdrawal.



Article seventh criticize education for members who do not carry out trade union resolutions or violate Trade Union regulations.

The expulsion of membership shall be subject to discussion by the trade union group, and shall be decided by the trade union's grass-roots Committee and submitted to the higher level trade union for record.



Eighth members may retire, retire and lose their jobs.

The membership fee is not retained during the membership.



Trade union organizations should concern themselves with the life of retired, retired and unemployed members, and actively reflect their wishes and demands to the parties concerned.



The second chapter is the organizational system.



The Ninth Chinese trade unions practise democratic centralism. The main contents are:



(1) individuals are subordinate to the organization, the minority is subordinate to the majority, and the subordinate organizations are subordinate to the higher level organizations.


(two) the leading bodies at all levels of trade unions are democratically elected except for the representative offices they send.


(three) the highest leading body of trade unions is the National Congress of trade unions and the Executive Committee of the all China Federation of trade unions.

Local leading bodies at all levels of trade unions are local congresses of trade unions and the Federation of trade unions which they produce.


(four) trade union committees at all levels shall be responsible for and report on their work to members of the same level or members' congresses, and shall be subject to the supervision of members.

The general assembly and members' Congress have the right to remove or remove the representatives and trade union committee members elected.


(five) trade union committees at all levels shall implement a system of collective leadership and division of responsibilities.

All major issues are discussed and decided by the Committee. Members of the Committee perform their duties according to the collective decisions and division of labor.


(six) the leading bodies at all levels of trade unions often inform the lower level organizations, listen to the opinions of lower level organizations and members, and study and solve the problems raised by them.

Subordinate organizations shall report to the higher level organizations.



The emergence of the representatives and committees of the tenth trade union congresses at all levels should fully reflect the will of the electors.

The list of candidates should be repeated and discussed fully.

By adopting secret ballot, the election can be directly carried out by means of the election method of the difference between the number of candidates and the number of candidates. Formal election can also be carried out by adopting the method of differential election. The list of candidates will be generated and then the official election will be held.

No organization or individual shall force the elector to elect or not to elect a person in any way.



The eleventh Chinese trade unions carry out the principle of organization and leadership combined with industry and locality.

A member of the same enterprise, enterprise or institution shall be organized in a grass-roots organization of the trade union, and a trade union of the same industry or of similar nature shall be established according to the needs.

In addition to a few administrative management systems that carry out vertical management, the trade unions of their industrial unions carry out the dual leadership of industrial unions and local trade unions. The leading cadres of industrial unions are all other industrial unions.

The leadership system of all industrial unions is determined by the all China Federation of trade unions.



Local federation of trade unions shall be established in provinces, autonomous regions, municipalities directly under the central government, autonomous prefectures, cities and counties (flags).

The local federation of trade unions is the leading organ of local local trade union organizations and local organizations of industrial unions.

A unified national all China Federation of trade unions has been established throughout the country.

The all China Federation of trade unions is the leading organ of all local federation of trade unions and national organizations of industrial unions.


The members of the Executive Committee of the all China Federation of trade unions and the members of the National Committee of the industrial union shall be substitutes, and the members of the local federation of trade unions at all levels and the members of the local industrial trade union committee may also make substitutes.



The twelfth local federation of trade unions at or above the county level may send out representative offices according to their needs.



The trade union committees at all levels above the county level and county level may convene meetings of representatives to discuss and decide on major issues that need to be resolved in time when the two Congress is deemed necessary.

The number of Representatives representing the conference and the method of formation shall be decided by the Federation of trade unions convened by the delegates.


The national industrial trade union, the local industrial unions at all levels, the township trade unions and the urban street trade union committees may, in accordance with the principle of joint system and representative system, be composed of the next level trade unions, the principal leaders of democratic elections and appropriate representatives of relevant parties.



Thirteenth trade union congresses at all levels elected the same level funding Review Committee.

The Standing Committee of the all China Federation of trade unions shall set up a standing committee, and the Provincial Federation, the autonomous region and the municipality shall also have a standing committee.

The fund review committee is responsible for examining the expenditure and property management of trade unions and their directly affiliated enterprises and institutions at the same level, supervising the implementation of financial laws and regulations and the use of trade union funds, and receiving the guidance of the higher level trade union finance review committee.

The trade union finance examination committee shall be responsible for and report on its work to the general assembly or members' congresses at the same level, and shall be responsible for and report on the work to the trade union committee at the same level during the session of the general assembly.



When the higher level funding committee considers it necessary or when the next level of Finance Examination Committee requests it, the higher level funding Review Committee may examine the expenses and property management of the subordinate trade unions and their subordinate enterprises and institutions.


Members of the all China Federation of trade unions' funding Review Committee shall be substitutes, and members of the local general trade union funding Committee and the members of the industrial union funds examination committee with independent management funds may also be substituted.



Fourteenth trade unions at all levels set up women's staff committees to express and safeguard the legitimate rights and interests of women workers.

The women's staff committee is nominated by the trade union committee of the same level, and is composed on the basis of full consultation, and is under the leadership of the trade union committee of the same level.



Fifteenth trade union organizations at all levels above county level and county level may establish legal advisory service institutions to provide services for the protection of the legitimate rights and interests of workers and trade union organizations.
